Privacy Policy — Marketly

Marketly is a trading name of Roly Limited, registered in New Zealand.

This Privacy Policy explains how Marketly ("Marketly", "we", "us") collects, uses, and protects information when you use trymarketly.com and the Marketly application (together, the "Service"). Marketly is the data controller for personal data processed through the Service.

1. Information we collect

Account data — name, email address, password hash, and authentication provider identifiers.
Workspace content — brand details, uploaded assets, prompts, and the marketing content you generate.
Billing data — plan, credit balance, invoices, and transaction identifiers. Card details are collected and processed directly by our payment provider, Stripe; we never see or store full card numbers.
Usage data — pages visited, features used, device, browser, IP address, approximate location, and diagnostic logs.
Referral data — partner referral codes captured when you arrive via a Marketly Partner link.

2. How we use your information

Provide, secure, and improve the Service.
Generate the AI marketing content you request.
Process payments and manage your subscription and credits (via Stripe as our payment provider).
Send transactional emails (account, billing, product updates you opt into).
Detect, prevent, and respond to fraud, abuse, and security incidents.
Comply with legal obligations.

3. Legal bases

We process personal data to perform our contract with you, with your consent (for example for optional marketing emails), to comply with legal obligations, and for our legitimate interests in operating and improving the Service.

4. Sharing your information

We share data only with vetted processors that help us run the Service:

Stripe Payments Europe, Ltd. ("Stripe") — our payment provider. Stripe processes payments, subscriptions, invoicing, and tax calculation on our behalf, and acts as an independent controller for the billing data it collects at checkout. See Stripe's Privacy Policy.
Cloud hosting and database providers.
AI model providers used to generate your content.
Email delivery providers for transactional email.
Analytics and error-monitoring providers.
Professional advisers (legal, accounting) and authorities where required by law.

We do not sell your personal information.

5. AI-generated content

Prompts and brand inputs you submit are sent to third-party AI providers to generate your output. We do not use your private workspace content to train public AI models. You own the content you generate, subject to our Terms of Service.

6. Data retention

We retain account and workspace data while your account is active. After you delete your account we remove personal data within 30 days, except where we (or Stripe, for billing records) must retain records for legal, tax, or fraud-prevention purposes.

7. Your rights

Depending on your location, you may have rights to access, correct, export, or delete your personal data, and to object to or restrict certain processing. To exercise these rights, email privacy@trymarketly.com.

8. International transfers

Marketly is operated from New Zealand and uses providers located in the EU, UK, and US. Where required, transfers are protected by appropriate safeguards such as Standard Contractual Clauses.

9. Security

We use encryption in transit, encryption at rest for sensitive fields, role-based access controls, and audit logging. No system is perfectly secure; please use a strong, unique password and notify us of any suspected compromise.

10. Children

The Service is not directed to children under 16, and we do not knowingly collect their data.

11. Changes

We may update this policy. Material changes will be notified via email or in-app notice before they take effect.
